Why Use A Law Firm?
Some people believe using a loan modification attorney can improve the chances of successfully modifying a loan or shorten the time needed to complete the process. We do not know if this is true, but we do know lenders sometimes perform the modification process improperly and actually make the situation worse for the homeowner. We have commenced litigation to stop foreclosures where clients have informed us of being rejected for reasons unsupported by the facts (such as by being told the application was incomplete when, in fact, all requested documents were provided), where a repayment agreement has been reached yet the lender schedules a foreclosure anyway, and a foreclosure auction being scheduled where a client actually overpaid the amount due.

Every Situation Is Different.
By using a law office for the mortgage modification process, a lawyer can closely monitor the actions of the lender. Irregularities can be used as leverage in the modification negotiations, or as outright causes of action should litigation become necessary.

Mortgage Loan Modification Options
We will pursue one or more of the following mortgage reduction methods to help reduce monthly payments:
  • Lower the interest rate
  • Convert the interest rate from a variable (adjustable) to fixed rate
  • Lower the principal amount
  • Extend the term of the loan (extending the number of years generally results in a lower monthly payment)
  • Reduce the amount of late fees or penalties already incurred


Litigation and Bankruptcy
If necessary, we also can seek an injunction to stop a foreclosure auction, file suit to challenge the enforceability of a loan, review loan documents for violations of the Truth in Lending Act ("TILA") and Real Estate Settlement and Procedures Act ("RESPA"), or refer you for bankruptcy protection. We also can assist with "short sales" and deeds in lieu of foreclosure.

Our Fees
We do not post our fees on-line, but will be happy to discuss them with persons who fill out the loan modification questionnaire. That said, generally speaking our fees should approximate what one might expect to pay when refinancing a loan with the assistance of an attorney. Litigation, bankruptcy and other services outside a conventional loan modification will cost more.
